Description
Providing our professional services in Deceased Estate Matters, let us aid you in one of the most vulnerable but inevitable moment in life when you lose a loved one.
We have more than 21 years expertise in this field of law.
Whether its testate succession (Will) administrated in terms of the Administration of Estates Act (Act 66 of 1965, as amended) or intestate succession, if you die without leaving a valid will, your estate will devolve according to the Intestate Succession Act, 1987 (Act 81 of 1987), we aim to aid you as the executor or be appointed as the executor of your estate in order to comply legally with the framework of the respective Acts to ensure that the Deceased Estate is adequately and rightfully distributed after death.
An executor is legally responsible for sorting out the finances of the person who died, generally making sure debts and taxes are paid and what remains is properly distributed to the heirs. Let us assist with this process.
Our service entails:
1. Drafting of FREE WILLS.
2. Gathering of all assets and accounting for all liabilities of the deceased's at the time of death.
3. Assist in the nomination of an executor.
4. Liaising with the Master of the High Court. Reporting the Deceased Estate.
5. Drafting the Final Liquidation and Distribution Account of the Deceased.
6. Leaving the Final Account with the Magistrates Court for inspection within the jurisdictional area of where the Deceased permanent resided.
7. Successfully paying off the debts of the deceased.
8. Successfully distributing the assets of the deceased to his/her rightful hiers in terms of the will or intestate.
